This website (the “Site”) is operated by Fort McMurray Airport Authority (“FMAA”). The Site and its content are subject to the terms and conditions contained in these Terms of Use (the “Terms”). The Terms apply to all users of the Site. Your use of the Site constitutes your agreement to the Terms. If you are dissatisfied with the Terms, your sole and exclusive remedy is to discontinue using the Site.

FMAA may modify the Terms at any time, and such modifications shall be effective immediately upon posting of the modified Terms. You agree to review the Terms periodically to be aware of such modifications and your continued access or use of the Site shall be deemed your conclusive acceptance of the modified Terms.

Access and Use of the Site

Subject to the Terms, FMAA grants you a limited licence to access and use the Site, including to display, copy, distribute and download its content, for your personal non-commercial use, provided that you do not modify the Site, its content or any copyright or other proprietary notices.

In the event that you breach any of the Terms, this licence will terminate automatically. Upon termination, you agree to immediately destroy all copies of any content in your possession. You acknowledge and agree that FMAA has the right, in its sole discretion, to terminate or suspend your access to all or part of the Site for any reason.

Unauthorized use of the Site or any content may violate copyright laws, trademark laws, the laws of privacy and publicity and communications regulations and statutes.

The Internet constitutes the largest resource supporting freedom of information today for the user community in general and for users with disabilities in particular. This website employs the Nagich By Click accessibility software and is connected through a special accessibility server. The software complies with Israeli standard SI 5568 at AA level. The software is subject to the manufacturer’s Terms of Use. The website owners and/or agents bear the responsibility for the usage and implementation on the website, including the content displayed on the website under the Terms of Use of the Software.

The Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada. You hereby irrevocably consent to the exclusive jurisdiction and venue of the courts in Fort McMurray, Alberta, Canada in all disputes arising out of or relating to the use of the Site. You agree to indemnify and hold FMAA, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable solicitor’s fees, asserted by any third party due to or arising out of your use of the Site. If any part of the Terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect. Unless otherwise specified herein, the Terms constitutes the entire agreement between you and FMAA with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and FMAA with respect to the Site. Waiver

No delay or omission by FMAA to exercise any right occurring upon any non-compliance on your part with respect to any of the Terms shall impair any such right or power or be construed to be a waiver thereof. Any waiver by FMAA of any of the covenants, conditions or agreements to be performed by you shall not be construed to be a waiver of any succeeding breach thereof or of any covenant, condition or agreement herein contained.

Fort McMurray Airport logos, marks, illustrations and other designated product and feature names and illustrations are protected marks of FMAA and may be used publicly only with prior permission from FMAA. Fair use of FMAA marks in advertising and promotion of FMAA products and services requires proper acknowledgment.
